The challenge of regulating social media stems from the tension between state sovereignty to address harms and the protection of fundamental rights such as freedom of expression and user privacy. In response, the European Union has established a general framework comprising the GDPR, Digital Services Act, Digital Markets Act, and AI Act. However, the criminalization of specific instances of illegal content is deferred to the domestic laws of member states. The GDPR protects sensitive data including racial origin and political opinions. The DMA designates very large platforms as "gatekeepers" and prohibits monopolistic behaviors. The DSA creates a framework for platform liability regarding illegal content, emphasizing transparency and reporting mechanisms. Key harms necessitating regulation include defamation, hate speech, incitement to violence, terrorist content, child sexual abuse material, racial discrimination, misleading advertising, data breaches, excessive data collection, unauthorized processing, violation of user rights, and monopolistic practices. he effectiveness of this legal architecture depends on continuous cooperation between the European Commission, national authorities, and the platforms themselves.
