The Basis of Civil Liability Arising from the Manufacture and Supply of Toys

Abstract
The widespread effects of toys, on the one hand, and the sensitive users of such products, on the other, have led to the preparation of regulations, rules, and standards in toy manufacture and supply. Therefore, it is significant to investigate the civil liability arising from the production and supply of toys. One of the main issues that affect all aspects of civil liability lawsuits is identifying the appropriate basis for holding the toy manufacturer or supplier, responsible in case of damage to the consumer. This article intends to explain the most appropriate basis for the responsibility of the toy manufacturer and supplier by analyzing the various bases of responsibility presented in the form of different theories. Considering the types of damages caused by the production and supply of toys, choosing a single basis for all is not appropriate. Therefore, regarding physical damages caused by toys, the “strict liability” of toy manufacturers and suppliers is suggested in the manner of jointly. For moral damages, as well as damages to third parties, the “Imputability theory” is the most appropriate; because it guarantees the victim's rights by not needing to prove the fault of the person causing the damage, facilitates the civil liability lawsuit, and does not limit the way of innovation in the production and presentation of new toys.
